Planning and Zoning Mission Statement

It is the mission of the Planning and Zoning Commission and Planning and Zoning Administrator to protect and promote the health, safety and general welfare of all citizens and neighborhoods of the City of Bowman through the professional administration and equitable enforcement of the City of Bowman’s zoning code and ordinances.  Similarly, it is also the Commission and Administrator’s mission to simultaneously maintain an atmosphere for business and industry to thrive by assisting developers and businesses in achieving compliance with the laws and policies adopted by the Bowman Planning and Zoning Commission, City Commission and those of the state and federal legislatures.

 

March 22, 2017

At the March 21, 2017 City Commission meeting, the Commission held a public hearing on the review of the final amendments to the “Land Development Code” (or more popularly known as “Chapter 6 Zoning Ordinances”).  After due consideration of the updates brought forward to the City Commission by the Planning and Zoning Commission, the final draft was unanimously approved 5-0.  The new amendments take effect immediately.  The updates include expansion of the definitions section, expansion of the uses allowed in each zoning district, the creation of new zoning districts, the inclusion of new design standards for development, and the refinement of the roles and responsibilities of city staff when implementing the Land Development Code.

 

Work will soon begin on the remainder of the chapters of the city’s municipal code.  Many of these chapters are out of date and need to be brought into compliance with newly passed legislation by the state of North Dakota.  The public is invited to attend all hearings related to this task.  If you have any questions, please call Bowman City Hall at 701-523-3309.

CITY OF BOWMAN MINUTES FOR

THE PLANNING AND ZONING COMMISSION MEETING

HELD ON MAY 13, 2025 AT 6:30 PM AT CITY HALL

 

Present:  President Ryan Shear, Dave Mosbrucker, Mike Beylund, Pam Fisher, Brianna Fleck, Kaitlin Brooks, Jean Nudell, Kady York, Ryan York, Tom Yockim, Theresa Yockim, Matt R., Jodi Tivey, Tonya Tysver, Rohim Reynolds, Dee Dobitz, Ken Dobitz, and Marie Snavely, and Peggy Allen.  Absent:   Byan Clendenen and Jory Reisenauer

President Shear called the meeting to order at 6:33 pm.  Motion by Beylund, second by Mosbrucker to approve the agenda.  AIF, MC.   Motion by Beylund, second by Fisher to approve the minutes from the 4/8/25 meeting.  AIF, MC.

Meowser’s Rescue:  Kady York presented her plan for the land that they purchased located at 8410 Highway 85 SW, Bowman ND.  This property is located in the City Extra-Territorial Zone.  It is a 1.8 acre tract in S1/2SE1/4 Section 1-131-102.  They want to live there and have a cat rescue with a retail business on the front part of the property.   The adoption center with retail will be approximately 12’ x 28’.    Their end goal would be to put up a metal shop.

York had different zoning designation than what the City zoning map shows.  Allen will contact the County to see why there is a discrepancy, the City has it as Agriculture (Ag), York stated its residential.  Shear stated that we have to go with the designation that we have as Agriculture.  Shear informed York that a Conditional Use Permit (CUP) would be required to be applied for in Ag for a kennel.  Motion by Beylund, second by Mosbrucker to require York to apply for a Conditional Use Permit (CUP) for a kennel which will require a public hearing.  AIF, MC.   Nothing was approved.

Case LDC25-001 Public Hearing for John Germann CUP Conditional Use Permit: President Shear explained that the public hearing is for consideration of a Conditional Use Permit for an 18 hole putting green course and soda shop with retail.  This property is zoned (C-1) Commercial and is located on lots 3-6 on Block 33 in the Milwaukee 1st Addition.

President Shear asked for someone to speak regarding the project.  Theresa and Tom Yockim were put in charge of this project by the owner John Germann.  Theresa described the project as an 18 hole putting green, (NOT a miniature golf course with little buildings) and a soda shop that sells repurposed antiques.  There will be an old english side garden with a pergola/swing on the south side, and benches for people to sit and rest.  The putting green will be established next year so they won’t be open until next season.   They will have insurance to cover accidents and their hours will be 10:00 am to 8:00 pm.  (Will be closed two days of the week.)  Theresa felt that the average person will be there 30 – 45 minutes for a drink and will putt for probably an hour.  Someone has already requested using the flower gardens area for a wedding.

Public Hearing:  President Shear opened up the public hearing to hear from the people that were present.  Jodi Tivey was concerned about their customers walking on the neighboring properties lawns and blocking driveways.  Theresa said they will put up signs asking people to be respectful of the neighboring properties and there will be some wrought iron fencing on the south side to keep people and deer out.  They have inquired about purchasing some vacant lots for parking but haven’t been successful at this point to purchase any.    There was a question regarding lights at night which may be harsh to the neighboring properties.  Theresa said they are not planning on having after dark lighting that will affect any of the neighboring properties, but stated there may be solar lighting around the lilacs.

Dee Dobitz said this project is an opportunity to bring some more business to our town, she can’t see downside to it.

Marie Snavely said she felt we should take this opportunity to make the city beautiful.

Allen explained that this property was still in Jerry Germann’s name but was left to John Germann in his will so they are working on getting that finalized with the attorney.  City Attorney Weiss stated it was okay to move forward with the CUP under John Germann’s name.

With there being no more comments from the public, President Shear closed the public hearing.  Motion by Beylund, second by Fischer to approve the Conditional Use Permit for John Germann for an 18 hole putting green and soda shop with retail.  AIF, MC.  It was explained to Theresa and Tom Yockim that they could keep working on the garden, but the final approval is not done until after it has been published in the newspaper, giving a 10 day appeal period.  Final Approval would be June 1, 2025 if no one appeals the decision.

Leland Sather Detached Garage:  Allen presented an application for a two car detached garage for Leland Sather at 106 3rd Ave NW, Lot 12, Block 5 or the Original Town.  He will have the siding the same color as the house.  There is an old building in the back of the property that will be torn down.   Motion by Beylund, second by Mosbrucker to approve his application for a 2 stall detached garage.  AIF, MC.

Gordon James Addition to James Cabinetry:  James is requesting to add  a 16’ X 36’ addition onto James Cabinetry.  He is zoned Commercial with a Gateway Overlay in a  3.13 acre in tract 2 in NW14 Section 13-131-102.  Motion by Mosbrucker, second by Fisher to approve the 16’ x 36’ addition for Gordon James.  AIF, MC.

Food Truck Regulations:  Allen has had several inquiries of regulations for food trucks.  She asked if there should be food truck regulations.  Discussion was held of maybe having them as permitted in commercial and industrial.  Motion by Beylund, second by Fisher to table food trucks until the next meeting.  AIF, MC.

Consideration of Two Meetings During Construction:  Discussion was held regarding having two meetings a month from May – September.  Motion by Mosbrucker, second by Beylund to table to the next meeting when everyone is here.  AIF, MC.

OLD BUSINESS:

Non-Compliance of Shed Permits:  Being deferred to the City Commission for action on the two sheds that are not in compliance.

Review Articles:  Look over Articles 9 and 11 for the next meeting.  Allen will review Articles 10 and 12 with Brosz Engineering.

Shear adjourned the meeting at 7:45 pm.
